Excerpt: ... his bond, and such endorser or surety is subjected to paying any part of the amount, and enters a demand therefor, the debtor will be posted as fraudulent, except he satisfies the demand within three days of the time of adjustment, or produces satisfactory testimony, that misfortunes, subsequent to the transaction, have prevented the possibility of making the payment himself. 6th. If a debtor deals under a concealed copartnership, or exhibits the appearance of a mercantile connexion, which does not in fact exist, for screening his property from his creditors, he will be a subject of complaint, and if convicted, he will be liable to the penalty of being posted as a fraudulent debtor. 7th. If a debtor be entrusted with a receipt for any sum due from him, in expectation of his paying the amount, and he retains the receipt without payment, he will be a subject for complaint, and if convicted of the fact, he will be posted as a fraudulent debtor, unless the sum due from him be paid within three days from the time of adjustment. In cases of this description, the fraudulent nature of the transaction will not be extenuated by a plea of the debtor, that he had made payment, by giving his note for the sum; as the creditor"s complaint is evidence that the note of the debtor was not acceptable, as a discharge of the debt. 8th. If a debtor obtains credit under any false pretence, and the deception is discovered by the creditor before payment is made by the debtor, he will be a subject for complaint, and if convicted of the fact, he will be posted as fraudulent, unless the sum due from him on that transaction be promptly paid at the time stipulated therefor between the parties.
